August 27, 2009 - At the emergency meeting of the Minnesota Gambling Control Board held on August 27, 2009, at the Board's office at 1711 West County Road B, Suite 300S, Roseville, Minnesota, the distributor license renewal application for Central Gaming Services, Saint Cloud, Minnesota and the manufacturer license renewal application for Technik Manufacturing, Inc., Columbus, Nebraska were approved. No other business was conducted at the emergency meeting that was conducted via telephone, with at least one board member physically present at the meeting location. August 24, 2009 - The licensing staff at the Gambling Control Board have been receiving many questions regarding the elimination of the organization's license and permit renewal process and the organization's annual fee date. Here are answers to the frequently asked questions.
RENEWALS AND ANNUAL FEE DATE We haven't received our license and permit renewal packets yet? Why are they late? Effective July 1, 2009, organizations are no longer required to submit license and permit renewal applications to the Gambling Control Board. That is because the law change on July 1, 2009 established a perpetual (ongoing) term for organization licenses, gambling manager licenses, and premises permits.
If there are no license and permit renewals, how do we know when to pay our annual license and permit fees? About a month before your organization's annual fee date, the Board will send a cover letter with an invoice for the annual fees required for your organization's license, gambling manager license, and for each premises permit showing activity at that time.
How do we know what our "annual fee date" is? The annual fee date is determined by the Board based on your organization's license date that was in effect as of July 1, 2009. For example, as of July 1, 2009 an organization had a license that was effective on August 1, 2008 and expired July 31, 2010. For this organization the annual fee date would be July 31 each year.
LOCAL GOVERNMENT REQUIREMENTS What information are we required to take to the city to renew our premises permits? None, because renewal applications are no longer required by the Gambling Control Board for premises permits. However, check with the city to see if they have any local reporting requirements or ordinances with which you must comply.
What if the city says it still wants to approve our premises permits? Effective July 1, 2009, the term of a premises permit is perpetual. That means the permit remains in effect until the organization terminates the site or the Board suspends or revokes the permit. Your organization does not have to obtain city approval once a premises permit has been issued by the Board. However, the city may charge an annual investigation fee, as long as it doesn't impose a local gambling tax. Check with the city to see what reporting requirements they have that pertain to lawful gambling.
CHANGES IN LICENSE AND PERMIT INFORMATION If renewal applications are no longer required, when do we submit license and permit information changes? Your organization is still required to submit changes to the Board in the following timeframes: • general information - within 10 days of the change;• lease changes - 10 days prior to the change; and• ownership changes - within 10 days after the change in ownership occurs.How do we report changes in application information to the Board? Use the following forms to report changes: • LG1015 Reporting Organization Information Changes;• LG1016 Reporting Gambling Manager Changes;• LG1017 Reporting Premises Permit Changes;• LG215 Lease for Lawful Gambling (for lease changes)• LG200B Organization Officers Affidavit (for your CEO and treasurer).LEASE INFORMATION When does our organization have to submit a new lease? Your organization must submit a new lease whenever information in the terms of the lease change, or when you are notified by the Board on your annual license fee date.
What is the process we must follow for amending our current lease? • Your organization must submit a new LG215 Lease for Lawful Gambling.• Use the most current lease form.EXPENSE CALCULATIONS Do we still have to maintain the expense calculation worksheet? No. Expense calculation limits were eliminated on July 1, 2009. However, the Board has until December 31, 2009 to impose a penalty or sanctions for expense calculation violations that occurred through June 30, 2009. Organizations whose 21st or 24th month is June 2009 or before must reimburse any negative expense balance.
